Where it stands

Risks to the lead

  1. Fact-check exposure on the FirstEnergy/HB6 ads. FactCheck.org (2026-09-17) found that it's true Husted backed the 2019 bailout law and that the company supported his campaigns, but "Husted hasn't been charged with or accused of any wrongdoing", which is the impression the ads may leave. Cleveland.com (2026-10-21) also rated one claim in a Brown farm-costs ad false. Repeated rebukes like these erode the credibility of Brown's contrast.
  2. Outside money closing late. Brown's money edge is in candidate funds. Pro-Husted PACs (Reuters, 9/21) can cancel out his cash-on-hand parity in the final week.
  3. The tone backlash runs both ways. The Columbus Dispatch poll op-ed (9/29) says Ohioans are "sick of toxicity". The NRSC crash-photo ad (OCJ 8/28) and the ad featuring Acton's mother (The Hill 10/20) hurt Husted, but WKRC (10/1) reports a Brown ad that used vulgar language.

What's working

Top 5 recommendations

  1. Reword the HB6 line to match what the fact-checkers verified. Draft: "Jon Husted backed the 2019 bailout law that FirstEnergy wanted, and FirstEnergy supported his campaigns." This is VERIFIED per FactCheck.org 2026-09-17. Do not say or imply he was charged.

  2. Pull or fix the farm-costs claim that Cleveland.com rated false (10/21). Line needs verification against the specific rating before it airs again.

  3. Close on affordability and data-center power costs (Signal Ohio 7/8; OCJ 8/10, contrasting data-center positions). Line needs verification: Husted's specific statements were not retrieved.

  4. Drop vulgar language and run contrast without profanity, taking advantage of the voter fatigue with toxic ads (Dispatch 9/29). This is a judgment call, not an ad line.

  5. Tie Husted to his Senate votes since his January 2025 appointment. Line needs verification: the senate.gov roll-call pages returned 403 and no voteview pull has been done yet.
